Merchant Terms of Service

1. Acceptance
By creating a merchant account, accessing, or using Birds Eye Brew ("BEB") at birdseyebrew.com, you agree to these Merchant Terms of Service and our Merchant Privacy Policy. If you do not agree, do not use the service.
2. Service Description
BEB provides software and account tools designed to help participating merchants operate loyalty and rewards workflows using supported integrations and merchant-configured settings. Features may include account management, supported POS connection tools, point accrual support, redemption tools, loyalty history, and related merchant-facing features.
3. Merchant Control and Responsibility
Merchants remain responsible for their business operations, staff activity, reward configuration choices, customer interactions, product availability, pricing, taxes, and compliance with applicable law. Merchants control which supported rewards or settings are enabled within the platform. BEB does not guarantee any particular commercial outcome, level of customer participation, or level of redemption activity.
4. Connected Accounts and Integrations
Certain features require a merchant to connect a supported third-party account or platform. By connecting such an account, you authorize BEB to access and process information made available through that connection as needed to provide the service. You are responsible for maintaining valid access to connected third-party accounts and for complying with the terms and policies of those third-party providers.
5. Account Security
Merchants are responsible for maintaining the confidentiality of account credentials and for activity that occurs under their accounts. You must notify us promptly if you suspect unauthorized access, misuse, or a security issue affecting your merchant account or connected systems.
6. Acceptable Use
You agree not to use the service in violation of law, to submit false or misleading information, to interfere with or disrupt the platform, to attempt unauthorized access, or to use the service to facilitate fraud, abuse, or deceptive practices. We may investigate suspected misuse and may suspend, limit, or terminate access where appropriate.
7. Data Accuracy and Corrections
Merchants are responsible for the accuracy of the information they provide, including business details, location details, connected account details, and reward settings. BEB may correct or adjust records, balances, or loyalty-related activity to address errors, refunds, voids, duplicate events, technical issues, or suspected abuse.
8. Availability
We work to keep the service available and accurate, but we do not guarantee uninterrupted operation, error-free performance, or availability on every device, merchant environment, or third-party platform. Features may change as integrations, product capabilities, and merchant workflows evolve.
9. Beta Features
Some features may be offered in beta, pilot, limited release, or pre-release form. Such features may be modified, suspended, or discontinued at any time and may be subject to additional limitations or support constraints.
10. Subscriptions, Billing, and Cancellation
Paid access to production merchant features is offered on a per-location subscription basis. Pricing, billing intervals, and any promotional terms are shown in the merchant settings portal at the time you subscribe. By starting a subscription, you authorize BEB to charge the payment method on file through our payment processor (Stripe) for each billing period until you cancel.
You may cancel a location subscription at any time from merchant settings. Cancellation stops future billing immediately for that location. After cancellation, the location enters a 30-day wind-down period: it remains visible on the consumer map, customers may redeem existing loyalty points, but no new points are awarded. When the wind-down period ends, the location is removed from the map and loyalty accrual remains disabled until you subscribe again.
You may reactivate a location during the wind-down period by subscribing again for that location. Optional tablet rental, if offered, is billed separately and may be subject to additional return and cancellation terms shown at checkout.
11. Fees and Future Agreements
Public access to the merchant site or service information does not by itself create a paid commercial relationship. Separate commercial terms, order forms, pricing terms, or subscription agreements may apply to merchants that use paid or production versions of the service.
12. Disclaimer and Limitation of Liability
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BEB disclaims warranties of any kind, whether express or implied. To the fullest extent permitted by law, BEB shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill arising from or related to your use of the service.
13. Changes
We may update these Merchant Terms of Service from time to time. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms.
